เรียน สมาชิกกลุ่มความร่วมมือทางเศรษฐกิจเอเชีย-แปซิฟิกและสมาชิกที่ได้รับเชิญให้เข้าร่วมการประชุม APEC 2022
เราประชาชนมีความยินดีอย่างยิ่งในวาระโอกาสที่พวกท่านเหล่าสมาชิกอันทรงเกียรติเข้าร่วมการประชุมครั้งนี้ ท่านจะได้รับการต้อนรับเข้าสู่เทศกาลแห่งการโกหกครั้งใหญ่ ตั้งแต่ความปลอมเปลือกของบริเวณที่ประชุม ถนนหนทางที่ท่านใช้จราจรมายังที่ประชุมที่ถูกซุกขยะไว้ใต้พรมแดงและโรยด้วยผักชีที่กลิ่นแรงยิ่งกว่ากุหลาบใดๆ การต้อนรับอย่างอบอุ่นและเสแสร้งนี้เป็นเครื่องมือที่ให้พวกท่านในฐานะสมาชิกรับรองความชอบธรรมของรัฐบาลเผด็จการอัปลักษณ์ในผ้าคลุมของการเลือกตั้งตามกติกาของรัฐธรรมนูญฉบับโจร
พวกท่านอาจสงสัยว่าประเทศนี้ก็เป็นประชาธิปไตยแล้วมิใช่หรือ หลังจัดการเลือกตั้งทั่วไปในปี 2562 แต่ภายใต้ผ้าคลุมรัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช ๒๕๖๐ และเงามืดของกองทัพไทยและสถาบันกษัตริย์ยังคงทำให้ประเทศนี้เป็นได้แค่ประเทศเสมือนประชาธิปไตย เป็นลิเกโรงใหญ่ที่ถูกกำกับโดยองค์กรเหนือรัฐธรรมนูญทั้งหลาย
เงามืดเหล่านี้มองเห็นเป็นรูปธรรมได้จากการที่ประเทศไทยยังบังคับใช้กฎหมายหมิ่นพระบรมเดชานุภาพ (มาตรา 112) อย่างเข้มข้นด้วยวิธีเหวี่ยงแหอย่างเกินขอบเขตของกฎหมายที่เป็นลายลักษณ์อักษร เจตนาทำให้ประชาชนหวาดกลัวในการวิพากษ์วิจารณ์สถาบันพระมหากษัตริย์เหตุเพราะไม่แน่ใจเส้นแบ่งที่ชัดเจนของกรอบกฎหมายที่พึงกระทำได้หลายคดียังดำเนินอยู่ มีผู้ได้รับความเจ็บปวดและผลกระทบจากการถูกกล่าวหาว่าก่ออาชญากรรมทางความคิด มีนิสิต นักศึกษา นักเคลื่อนไหวทางการเมืองและนักสิทธิมนุษยชนพบว่าถูกรัฐซึ่งใช้เพกาซัสสปายแวร์แอบสอดส่องการใช้เครื่องมืออิเล็กทรอนิกส์และละเมิดความเป็นส่วนตัว ด้วยเหตุเพราะมั่วสุมกันคุยเรื่องการส่งเสริมเสรีภาพของประชาชน
ประเทศนี้ยังปกครองด้วยระบอบอำนาจนิยมที่กำลังทางกายภาพมีค่าเหนือสิ่งอื่นใด ปืนมีค่ามากกว่ากฎหมาย รัฐธรรมนูญเป็นแค่กระดาษเปื้อนหมึกที่พร้อมจะทิ้งขยะแล้วเขียนใหม่ตามแต่ผู้ถืออำนาจต้องการไม่ต่างอะไรกับการจดใส่กระดาษชำระที่นำไว้ใช้เพียงชั่วครู่ยามเท่านั้น
หลังรัฐประหารในปี 2557 คณะรัฐประหารและรัฐบาลจำแลงภายใต้การนำของพลเอกประยุทธ์ จันทร์โอชา ได้มีการขยายพระราชอำนาจให้สถาบันกษัตริย์ เริ่มจากการมีรับสั่งให้แก้ไขรัฐธรรมนูญในส่วนที่เกี่ยวข้องกับสถาบันกษัตริย์หลังจากที่ผ่านการทำประชามติรับรองแล้ว ในปี 2559 อันเป็นการกระทำที่ขัดต่อระบอบการปกครองประชาธิปไตยที่กษัตริย์อยู่ใต้รัฐธรรรมนูญ
นอกจากนั้นแล้ว ในระหว่างการเลือกตั้ง 2562 ที่ผ่านมา ได้มีการออกประกาศโดยสถาบันกษัตริย์ วินิจฉัยการกระทำของทูลกระหม่อมหญิงอุบลรัตนราชกัญญา สิริวัฒนาพรรณวดี เมื่อมีประกาศดังกล่าวลงมา ศาลรัฐธรรมนูญซึ่งเป็นองค์กรอิสระก็รับลูกด้วยการวินิจฉัยให้พรรคไทยรักษาชาติต้องถูกยุบไป โดยใช้ข้ออ้างว่าเป็นการกระทำที่บ่อนทำลายสถาบันพระมหากษัตริย์ทั้งที่ไม่มีบทบัญญัติใดห้ามทูลกระหม่อมหญิงอุบลรัตน์ราชกัญญา สิริวัฒนาพรรณวดี ลงสมัครในตำเเหน่งนายกรัฐมนตรีของราชอาณาจักรไทยเเละ กรรมการการเลือกตั้งเองก็ยืนยันข้อเท็จจริงนี้ก่อนพระบรมราชโองการดังกล่าวจะถูกเผยเเพร่ต่อสาธารณะ ยิ่งเป็นการตอกย้ำถึงการใช้อำนาจเกินกว่าที่รัฐธรรมนูญบัญญัติไว้
รัฐบาลนี้ยังได้ขยายอำนาจ เปิดช่องโหว่ให้สถาบันกษัตริย์รับเงินจากเหล่าพ่อค้านักธุรกิจ อันนำไปสู่การตั้งคำถามถึงการรับเงินเพื่อสร้างเครือข่ายทุนศักดินาและอำนวยความราบรื่นของการประกอบการณ์
นอกจากนี้ รัฐบาลประยุทธ์ยังได้สั่งให้มีการแก้กฎหมายเกี่ยวข้องกับการจัดการทรัพย์สินส่วนพระมหากษัตริย์ อันเป็นการเปิดช่องให้กษัตริย์เป็นคนร่วมลงทุนถือหุ้นส่วนผลประโยชน์ ในขณะที่รัฐธรรมนูญให้การคุ้มครองจากการถูกฟ้องร้องดำเนินคดีใดๆก็ตาม ซึ่งครอบคลุมกรณีการพิพาทในการประกอบธุรกิจ ทำให้ถูกตั้งคำถามถึงการลงทุนที่สถาบันกษัตริย์ได้รับผลประโยชน์ โดยที่ไม่ต้องรับผิดชอบใดๆ หากมีการกระทำผิดหรือละเมิดสิทธิมนุษยชนที่เกิดขึ้นจากการลงทุนนั้นๆ
การละเมิดสิทธิมนุษยชนในรัฐไทยยังคงดำเนินต่อไปเเม้ในขณะที่พวกท่านเดินอยู่ในศูนย์ประชุม เเละมันจะเกิดขึ้นอีกเรื่อยไปหากพวกท่านเเสดงท่าทีเป็นมิตรกับผู้นำที่มาจากรัฐธรรมนูญฉบับคณะรัฐประหารฉบับนี้ โปรดพิจารณาถึงสาส์นฉบับนี้ที่มอบให้ท่านในฐานะเหรียญอีกด้านที่ถูกคว่ำไว้เเละปัญหามากมายที่รัฐบาลซุกไว้จนไม่พอจะปิดไว้ใต้ใบบัว โปรดได้ยินเสียงของผู้คนที่อาศัยอยู่ภายใต้การปกครองของรัฐบาลที่จัดเจนเรื่องการตลบเเตลงเเละปลิ้นปล้อนอยู่เป็นนิจ

Dear members of the Asia-Pacific Economic Cooperation community and invited members of APEC 2022,
We, the people, are delighted with the occasion of having each respected member at this year’s meeting. You will be welcomed into this great festival of lies, from the artificiality of the meeting area to the same roads that you take to reach the meeting; the rubbish has been brushed underneath velvety red carpets and sprinkled with cilantro that smells stronger than even roses. However, this warm but hypocritical welcome is merely a means for you, as members, to certify the legitimacy of an ugly, tyrannical government that disguises itself behind an election under the rules of a thief’s constitution.
You may be asking yourself, isn’t Thailand already a democracy? Surely it has to be after the general elections of 2019. Sadly, this is not the case. Under the veil of the 2017 Constitution of the Kingdom of Thailand, and the shadow of the Thai military and monarchy, this country is merely a resemblance of a democracy. It is a large theatrical performance being directed by organizations above the constitution.
These shadows are visibly tangible in Thailand’s continued and intense enforcement of the lèse-majesté law (Article 112) by casting their nets beyond the scope of written law. This intent has caused people to be scared to criticize the monarchy because they are uncertain of the boundaries of a legal framework, one that, even recently, causes many cases to still be ongoing. People have been hurt and affected by allegations of thought crime. Students, political activists, and human rights defenders have found their phones exposed by the state through Pegasus spyware, which spies on their electronic devices and violates their privacy. All because they gather together to talk about the promotion of civil liberties.
This country is also still ruled by an authoritarian system, where physical force reigns supreme and guns are worth more than the law. The constitution has been reduced to just an ink-stained piece of paper that is ready to be trashed and rewritten whenever the holders of power want, it is no different from writing down on toilet paper that is only going to be used for a short time.
The monarchy, which is supposed to be an institution beyond politics, had in turn, become one of the most important actors in politics during the junta government. It started with its intervention in the drafting of the constitution, by amending parts related to the monarchy after the people had already accepted the 2016 draft constitution in a referendum. This was an act that did not respect the decision of the people while portraying the monarchy as the establisher of the constitution, instead of the true holders of sovereign power, the people. The monarchy also exercised power over all government agencies, when it issued an official palace announcement, dated 8 February 2022, ruling on the actions of HRH Princess Ubolratana Rajakanya Siriwattana Phannawadee as if it were a constitutional judge itself. When the royal command of the king came down, the constitutional court, an independent body, accepted the verdict and made a ruling that the Thai Raksa Chart Party had to be dissolved, on the pretext that it was an act of subversion on the monarchy. This was despite the fact that there is no provision forbidding Princess Ubolratana Rajakanya Siriwattana Phannawadee to apply for the position of Prime Minister of the Kingdom of Thailand. A fact that The Election Commission also confirmed even before the royal decree was made public. Thus, it is evident that the monarchy has exercised more royal power than the constitution stipulates.
The Thai monarch, himself, acts as a godfather, accepting money from merchants and businessmen to facilitate the flow of business rather than being the father of a land filled with love and compassion for his people. In addition, the Thai monarch crowns himself with the hats of merchants, businessmen, and venture capitalists with monopolistic interests. This all happens while the constitution provides him protection from any litigation, including cases of business disputes. Therefore, allowing the monarchy to benefit without being accountable for any of its wrongdoings.
Human rights violations in the Thai state continue even as you are walking within the walls of the convention center, and they will keep happening if you continue to be friendly with the leaders who derive their power from the current junta-drafted constitution.
Please consider this epistle, as the other side of the coin; a coin that has been turned upside down to reveal the many problems the government has hidden under, and please hear the voices of the people living under the rule of a government who are proficient in perpetual deception and deceit.
